All those who file for chapter 7 bankruptcy in Alabama will be required to attend a 341 hearing, also known as a meeting of creditors.
Preparing for the 341 Hearing
Before the meeting of creditors, you should review your bankruptcy petition and if any errors or omissions are found, notify your attorney immediately. You should also be prepared to discuss your petition with the trustee at the 341 hearing.
You may be required (confirm with your attorney) to bring the following to the meeting:
- An approved photo identification
- A social security card or other proof of Social Security number
- Documents that reflect a change in your financial situation since you filed the bankruptcy petition
You’ll also want to bring a copy of your bankruptcy paperwork to refer to during the meeting, along with anything else your attorney tells you might be needed.
What Happens at the Meeting of Creditors?
The chapter 7 bankruptcy trustee will conduct the hearing, swear the debtor in, verify the debtor’s identity, and ask a series of questions concerning the bankruptcy paperwork. Any creditors who attend the 341 meeting are also entitled to ask questions.
During the meeting, the trustee will check the accuracy of all reported income, inquire about any unreported sources of income or property, and look for signs of potential fraud. In most cases, the 341 hearing will be relatively short, usually under 20 minutes.
