The Proposed National Chapter 13 Plan

The Federal Rules Committee has proposed a National Chapter 13 Plan at Rule 3015(c) of the Bankruptcy Rules that, if approved, would go into effect on December 1, 2015.   The national plan is intended to standardize consumer cases and make it easier for pro se debtors as it comes with an instruction booklet.  The national plan will also make it easier for large creditor firms to quickly look over plans as it standardize

As we all know, it seems to take the government an eternity to accomplish any task, from filling potholes to passing a budget, and applying for Social Security disability benefits is no exception.

You can pretty much count on the Social Security Administration (SSA)  taking about four months to make an initial determination on your application.  According to www.ssdfacts.com, in Alabama only about 28% of the applications are approved at the initial level, which is below the national average of about 32%.

What is a Chapter 13 Plan?

The chapter 13 plan is a document prepared by your attorney and filed with the court that outlines how you will repay your debts over the life of your plan. In other words, it is a repayment plan. The chapter 13 plan directs the trustee on how your chapter 13 payments are to be disbursed to the creditors each month and how long you will be in the plan. A chapter 13 plan may look different from one district to another but the essential premise of the document is the same.
