Exceptions to the Automatic Stay

- Family court. If you are about to divorce or are already divorced, your ex-spouse can initiate proceedings to determine the paternity of your child, change, determine the amount of spousal or child support to pay, decide child custody and visitation issues, and address domestic violence disputes.
An automatic stay will remain in effect for 30 days after you file your bankruptcy petition. If you have had two or more bankruptcy cases dismissed within the past year, it won’t go into effect at all.
