Stopping Collection Activity Attorney in Gadsden, Alabama

Gadsden Bankruptcy Lawyers Protect Clients from Creditor Harassment

Alabam Bankruptcy Law Firm Focuses on Automatic Stays

Once you have filed your paperwork with a Gadsden bankruptcy court, an automatic stay will immediately take effect. This is a provision that prevents creditors from contacting you directly to collect what you owe or staking a claim on any of your property. An automatic stay will also stop home foreclosure proceedings.

Exceptions to the Automatic Stay

However, there are several exceptions to the automatic stay that allow creditors to still try to collect money from you, even though you have filed for bankruptcy. These exceptions include:

  • Criminal matters. Regardless of a bankruptcy case, if a government prosecutor files charges against you, it will proceed, meaning that you can still be indicted, tried, sentenced, and incarcerated.
  • Collection of child support or alimony payments. Support currently being paid can continue, regardless of a bankruptcy filing, and unpaid support arrearage can start or continue.
  • Taxes. Tax authorities can start or finish tax audits, send you a notice of unpaid taxes, request that you file tax returns, assess your taxes, and in limited situations, file a tax lien during a bankruptcy.
  • Family court. If you are about to divorce or are already divorced, your ex-spouse can initiate proceedings to determine the paternity of your child, change, determine the amount of spousal or child support to pay, decide child custody and visitation issues, and address domestic violence disputes.

An automatic stay will remain in effect for 30 days after you file your bankruptcy petition. If you have had two or more bankruptcy cases dismissed within the past year, it won’t go into effect at all.
